Several Tobacco companies are planning to ask the U.S. Supreme Court to intervene and overturn a May racketeering lawsuit ruling that requires them to tell the truth about the dangers of smoking and of "light" and "low-tar" cigarettes.

When Boston trolley operator Aiden Quinn ran into a trolley ahead of him last May, he admitted he was texting his girlfriend.  Today the 24-year-old was arraigned and could spend three years in prison for gross negligence operating a train.

Two years ago, Kayla Hess of West Palm Beach, Florida had an ongoing strep throat. A month of antibiotics didn't cure it, but staying off the Listerine Agent Cool Blue dental rinse did.  Now the 12-year-old has filed a lawsuit, but some parents say the reformulated product isn't much better.

Wal-Mart Stores has agreed to better control crowds, something it didn’t do in its post-Thanksgiving Day stampede that left one man dead in a Long Island store last year.  It's part of a settlement to avoid a repeat at all 92 New York stores and it also avoids criminal prosecution for the giant retailer.

A lawsuit has been filed on behalf of Armando Hernandez, a mentally challenged 21-year-old, who was the subject of staff induced beatings between residents, that's been dubbed "The Fight Club" by the media.  Texas has immunity from lawsuits, but the smoking gun is the video captured by cell phones belonging to the state.

The National Transportation Safety Board confirms today that the train engineer of a Metrolink commuter train sent his last text message 22 seconds before he ran head-on into a freight train, killing 25 passengers aboard.

The first wrongful death lawsuit has been filed in connection with last Friday's collision of a Metrolink commuter train with a freight train. Southern California has been slow to adopt new technology that serves to prevent human error. With the technology, "there's no question the accident would not have occured," says attorney Paul Kiesel.

The story just keep getting worse from Las Vegas where 40,000 are being urged to be tested for hepatitis and HIV. And a second clinic owned by the same group is reported to have reused fluids that clean colonoscopy equipment. One medical negligence lawsuit has been filed, others are expected to join in a class action.
